MOVING FORWARD. The Strata Schemes Management Amendment (Child Window Safety Devices) Act 2013 (“Act”) and Strata Schemes Management Amendment (Child Window Safety Devices) Regulation 2013 (“Regulation”) came into force on 11 December 2013.
What are the New NSW Window Safety Laws?
Late last year, NSW Parliament passed safety laws that aimed at decreasing the number of children falling from residential strata premises.
Owners Corporations must install window safety devices in dwellings above ground floor so that when the window is locked, the window will not be able to open more than 12.5 centimetres, thus hopefully preventing children from falling through.
When Do the Laws Come into Effect?
Owner Corporations has a responsibility to install the new safety devices. Owner Corporations can be held accountable for non compliance from 13 March 2018.
They must be installed correctly. This means that the Owners Corporations must meet to agree on when and how safety inspections and installations will be carried out.

As you may be aware, legislation has been introduced that requires the Owners Corporation install and maintain window locks as a child safety device.
Strata Schemes have until 13th March 2018 to comply which grants the Owners Corporation due time to consider implementation and costs.
At this stage, we are awaiting from Strata Community Australia guidelines on what locking devices are considered appropriate after which we will be seeking a schedule of costs from trusted providers which we will offer to you for consideration.
